1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("you" or "user") and Ayafy regarding your access to and use of the App and its services (collectively, the "Services").

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, via in-app notification or email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

The App is intended for personal, non-commercial use to support Quran memorization and recitation practice. Use of the App in any jurisdiction where such use is prohibited by law is not permitted.

2. Description of Services

Ayafy is a Quran memorization and recitation companion app that enables users to:

• Read and navigate the complete Quran with Arabic text and translations
• Practice recitation with real-time AI-powered feedback and error correction
• Track memorization progress across Sabak (new lesson), Sabki (recent revision), and Manzil (full revision) sessions
• Set and monitor daily memorization goals
• Manage and organize their personal Hifz (memorization) journey

We may, at our sole discretion, update, modify, suspend, or discontinue any aspect of the Services at any time, temporarily or permanently, with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Services.

3. User Registration

To access the full features of Ayafy, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information about yourself
• Maintain and promptly update your account information to keep it accurate
• Keep your password and account credentials confidential
• Be fully responsible for all activity that occurs under your account
• Notify us immediately at hello@ayafy.com if you suspect unauthorized access to your account

We reserve the right to refuse registration, reclaim usernames, or terminate accounts in our sole discretion, including if we determine a username is inappropriate or if you violate these Terms.

4. User Representations

By using Ayafy, you represent and warrant that:

• All registration information you provide is true, accurate, current, and complete
• You have the legal capacity to enter into these Terms and comply with them
• The date of birth you provide during onboarding is accurate; if you are under 13, a parent or legal guardian must complete setup on your behalf
• You will not access the App through automated or non-human means (bots, scripts, scrapers) unless expressly authorized
• You will not use the App for any illegal, unauthorized, or prohibited purpose
• Your use of the App will not violate any applicable law, regulation, or these Terms

If any information you provide is untrue, inaccurate, or incomplete, we may suspend or terminate your account and refuse current or future access to the App.

5. Intellectual Property Rights

Ownership

Unless otherwise indicated, the App and all its content, features, and functionality — including but not limited to source code, design, text, graphics, audio, and software — are owned by Ayafy and protected by applicable intellectual property laws. All trademarks, service marks, and logos displayed in the App are the property of Ayafy or their respective owners.

Proprietary systems

The following are proprietary to Ayafy and protected under applicable law:

• AI-powered Quran recitation analysis and feedback systems
• Memorization progress tracking logic (Sabak, Sabki, Manzil framework)
• Quran-aware speech recognition and error correction algorithms
• All app interfaces, visual designs, and learning flows

Quran content

The Quran text, translations, and associated recitation audio provided within the App are used under appropriate licenses or in accordance with applicable law. The Quran is the word of Allah and is not the proprietary property of Ayafy. Ayafy makes no claim of ownership over the Quranic text itself.

Limited license to you

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes strictly in accordance with these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or exploit any part of the App or its content without our express prior written permission.

6. License to Use the App

Subject to these Terms, Ayafy grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use one copy of the App on a mobile device that you own or control, solely for your personal, non-commercial Quran learning purposes.

You shall not:

• Copy, reproduce, or distribute the App or any part of it
• Attempt to derive or access the source code of the App
• Reverse-engineer, decompile, disassemble, or translate the App
• Modify or create derivative works based on the App
• Attempt to gain unauthorized access to the App's systems or networks
• Use the App in any way that violates applicable law or these Terms

We and our licensors own and shall retain all intellectual property rights in the App, including any updates, improvements, or modifications made to it.

7. Voice Recordings & User Content

Your content

When you use Ayafy's recitation features, you submit audio recordings of your Quran recitation ("Voice Content"). When you update your profile, you may upload a photo taken with your device camera ("Profile Photo"). You also generate memorization progress data, session logs, and preferences ("User Content") through your use of the App.

You retain ownership of your Voice Content and User Content. By using the App, you grant Ayafy a limited, non-exclusive, worldwide, royalty-free license to process, store, and use your Voice Content and User Content solely to provide and improve the Services to you. This license does not permit us to sell, publicly share, or use your content for AI model training without your explicit prior consent.

Recitation recordings

Voice recordings are captured only during active recitation sessions that you explicitly initiate. We do not record audio passively or in the background. All recitation processing is performed by our own custom system on our own infrastructure — your audio is never sent to external AI providers.

Optional training consent

By default, your recitation data is never used to train or improve our AI model. If you choose to help improve Ayafy's accuracy, you may enable this via Settings → Privacy → Improve Ayafy.

If you opt in: you grant Ayafy a limited, revocable license to use anonymized copies of your recitation audio solely to train and improve our custom Quran speech recognition model. All training data is stripped of personal identifiers before use and is never shared with third parties.

If you opt out (the default): no recitation data is used for any training purpose. Your audio is processed only to generate your session feedback.

You can change this setting at any time. Withdrawing consent means your data will not be used in any future training runs. Opting out has no effect on your access to any feature of the App.

Your responsibilities

You represent that your use of the App and any content you provide:

• Does not infringe any third party's intellectual property or privacy rights
• Is not false, misleading, or harmful
• Complies with all applicable laws and these Terms

8. Prohibited Activities

You may use Ayafy only for lawful purposes in accordance with these Terms. You agree not to:

Misuse of the App

• Use the App for any purpose other than personal Quran memorization and learning
• Access or use the App in any manner that violates applicable law or the rights of others
• Use the App to develop or assist in developing a competing product or service

Security violations

• Circumvent, disable, or interfere with any security feature of the App
• Attempt to gain unauthorized access to any account, system, or network
• Upload or transmit viruses, malware, or any harmful code

Automated access

• Use bots, scripts, scrapers, or automated tools to access or interact with the App
• Create accounts by automated means or under false pretenses

Conduct

• Impersonate any person or misrepresent your identity or affiliation
• Harass, threaten, abuse, or intimidate any person
• Engage in any activity that places an undue burden on the App's infrastructure
• Use the App in any way that brings disrepute to the Quran or Islamic learning

Commercial misuse

• Sell, resell, license, or otherwise exploit access to the App without our written consent
• Transfer or assign your account to any other person

9. App Store Platform Terms

General

Ayafy is distributed through the Apple App Store and Google Play Store. Your download and use of the App through these platforms is also subject to the respective platform's terms of service.

Apple App Store

If you download Ayafy from the Apple App Store, the following additional terms apply:

• These Terms are between you and Ayafy only — not Apple. Apple is not responsible for the App or its content.
• Your use of the App must comply with Apple's App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any App failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligations regarding the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or consumer protection claims. Ayafy is solely responsible for such claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms solely as they relate to your App Store license. Upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

Google Play Store

If you download Ayafy from the Google Play Store, your use is also subject to the Google Play Terms of Service. In the event of a conflict between Google Play's terms and these Terms, these Terms will govern to the extent permitted.

10. Subscriptions & Payments

Ayafy is currently available as a free app. All core features are provided at no charge during this period.

We reserve the right to introduce premium subscription tiers in the future. If and when paid features are introduced, we will update these Terms and notify existing users in advance. Any future subscriptions will be governed by the following principles:

• All in-app purchases will be processed through the Apple App Store or Google Play Store using their respective payment systems
• Subscription fees, billing cycles, and cancellation terms will be clearly disclosed before purchase
• Refunds will be handled in accordance with the refund policies of the platform through which you made the purchase
• Price changes for existing subscribers will be communicated at least 30 days in advance

11. Privacy

Your use of Ayafy is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

The Privacy Policy explains in detail how we handle your personal information, voice recordings, and usage data — including your rights to access, correct, and delete your data.

12. Disclaimer of Warranties

THE AYAFY APP AND ALL SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (1) THE APP WILL MEET YOUR REQUIREMENTS; (2) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (3) ANY ERRORS IN THE APP WILL BE CORRECTED; (4) THE AI-POWERED RECITATION FEEDBACK WILL BE ACCURATE, COMPLETE, OR FREE FROM ERROR; OR (5) THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AYAFY'S RECITATION FEEDBACK IS GENERATED BY AI AND IS INTENDED AS A LEARNING AID ONLY. IT IS NOT A SUBSTITUTE FOR QUALIFIED HUMAN SCHOLARSHIP, QURAN TEACHERS (SHEIKHS), OR CERTIFIED TAJWEED INSTRUCTION. USERS SHOULD VERIFY ALL FEEDBACK WITH QUALIFIED SCHOLARS WHERE ACCURACY IS CRITICAL.

Some jurisdictions do not allow exclusion of implied warranties, so the above exclusions may not fully apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AYAFY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO AYAFY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply.

14. Indemnification

You agree to defend, indemnify, and hold harmless Ayafy and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the App
• Your violation of these Terms
• Your breach of any representation or warranty in these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any harmful act you take toward another user of the App

We reserve the right, at our expense, to assume exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of any such claim.

15. Termination & Account Deletion

Your right to delete your account

You may delete your account at any time from Settings → Account → Delete Account within the app. Account deletion works as follows:

• Immediate deactivation: upon initiating deletion, your account is deactivated and you lose access to all app features
• 30-day grace period: your data is securely retained for 30 days after the deletion request. If you sign back into the App during this window, your account and all associated data — memorization progress, recitation history, settings — are fully restored with no loss
• Permanent deletion: if you do not return within 30 days, all your personal data is permanently and irreversibly deleted from our servers. This cannot be undone

Our right to terminate

We reserve the right, in our sole discretion and without notice or liability, to:

• Suspend or terminate your access to the App at any time for violation of these Terms
• Delete an account and its associated data for repeated or severe violations, with or without notice
• Block access from specific devices or IP addresses

If your account is terminated by us for a violation of these Terms, you are prohibited from creating a new account under any name without our prior written consent.

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including Sections 5, 12, 13, 14, 16, and 17) shall survive.

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Kannur, Kerala, India.

You agree that any claim or cause of action arising from your use of the App must be filed within one (1) year after the cause of action arose, or such claim will be permanently barred.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

17. Miscellaneous

Entire agreement

These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Ayafy regarding your use of the App and supersede all prior agreements.

Waiver and severability

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and an enforceable term will be substituted that most closely reflects the original intent.

Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, or sale of assets.

Force majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, natural disasters, infrastructure outages, or third-party service failures.

No third-party beneficiaries

Except as expressly provided (e.g., Apple as a third-party beneficiary for App Store users), these Terms do not create any third-party beneficiary rights.

Electronic agreement

You agree that these Terms, accepted electronically, are legally binding and have the same force and effect as a written signed contract. You waive any right to claim that these Terms are unenforceable due to their electronic form.
